Terms and conditions of purchase.
Your order and purchase is made on the basis of the terms outlined here in full.
They may not be modified or altered in any way.
Your order and purchase are governed by the Laws of New South Wales.
Each party unconditionally submits to the jurisdiction of the State of New South Wales,
Australia only.
You warrant that the details you provide for the purposes of this web site are correct.
If you are acting on behalf of a company or as an agent you warrant that you have
actual authority to enter into this agreement. You indemnify all actions against NETic
if it is found that you do not have the required authority.
By entering this site and this agreement you give your express approval for NETic
to obtain information required to complete your order and purchase. You agree to NETic’s
use of cookies in enabling the operation of the site as outlined in the Privacy statement.
NETic will treat as private any information that you submit in the course of your
dealings with NETic through the web site in accordance with the Privacy statement.
NETic will not deal with your provided information except as is required to process
your order and purchase and as NETic is otherwise required to deal with your
information as required by law.
Order acceptance and the completion of the contract between you and NETic will take place on the dispatch of the Products ordered to you unless we have notified you that we do not accept your order.
Non-acceptance of an order may be a result from one of the following:
- The product you ordered being unavailable from stock
- Our inability to obtain authorisation for your payment
- The identification of a pricing or product description error
You agree to the cost, indicated as the "Grand Total" figure, in United States Dollars (USD)
as is outlined in the "Shopping Cart" facility.
Your selection of item/s that you have identified on the "Shopping Cart" facility
is at law considered to be an invitation to treat. An offer is constituted,
on the terms outlined in this statement, on the basis of your selection and the
indicated total purchase price. Your acceptance will be indicated by you clicking on
the "Pay Now" button. By clicking the "Pay Now" you indicate your intention to
accept these terms and conditions as part of your order and purchase.
Once your acceptance is communicated to NETic you will be required to complete the
transaction by authorising NETic, through a credit card payment service facility
provided by WorldPay to debit your credit card account according to the stipulated
price in the "Shopping Cart" facility.
Any taxes that apply to this transaction are those that would apply to the
transaction as if it were conducted in the State of New South Wales, Australia.
NETic accepts no liability whatsoever for any loss whether caused directly or
indirectly through the use of this web site or through contracting with NETic
over the Internet. You agree to assume the full risk of contracting with NETic
over the Internet and indemnify NETic for any and all losses you incur.
NETic accepts no liability whatsoever for any actions by third parties that
interfere with this transaction. You acknowledge that technical difficulties
may interfere with the operation of this transaction and assume this risk in
accepting this offer.
If by reason of any fact or circumstance, matter or thing beyond the reasonable
control of NETic or you as the purchaser, either is unable to perform in
whole or in part any obligation under this agreement that party is relieved
of that obligation under this agreement to the extent and for the period that
it is so unable to perform and is not liable to the other party to this agreement
in respect of such inability.
If any provision of these terms and conditions is deemed to be illegal, invalid,
void or voidable, the validity of the remainder of the terms and conditions will
not be affected and will continue to be in force and have effect.
